It can be implemented in an attempt <em>to avoid litigation and resolve individual disputes between natural or legal persons and companies or institutions.<\/em><\/span><\/strong><\/p>\n<p class=\"p1\"><strong><em><span class=\"s1\">This form is intended to help direct you to the appropriate mediator who can look into your request, if such a person exists.<\/span><\/em><\/strong><\/p>\n<p class=\"p1\"><strong><em><span class=\"s1\">If you have already made an application to the competent Mediator and would like additional information about your class=\"gsection_title\">M\u00e9diation de la consommation<\/h2><div class='gsection_description' id='gfield_description_43_20'><p><em>Consumer mediation applies to a national or cross-border dispute between a consumer and a trader. It is governed by the provisions of Order No. 2015-1033 of 20 August 2015 on alternative dispute resolution for consumer disputes.<\/em><\/p>\r\n<p>In addition, this order defines a number of eligibility criteria for your consumer dispute.<\/p>\r\n<strong>In fact, mediation of consumer disputes does not apply to:<\/strong>\r\n<div class=\"bpcmsp\">\r\n<span> Disputes between traders; <\/span>\r\n<span>Requests made by the consumer to the trader's customer services;<\/span>\r\n<span>Direct negotiations between the consumer and the trader;<\/span>\r\n<span>Attempts at conciliation or mediation ordered by a court called to rule in the consumer dispute;<\/span>\r\n<span> Proceedings taken by a trader against a consumer. <\/span>\r\n<\/div>\r\n<strong>Disputes concerning the following are not considered consumer disputes<\/strong>\r\n<div class=\"bpcmsp\">\r\n<span> Non-economic services of general interest; <\/span>\r\n<span>Health services provided by health professionals to patients to assess, maintain or restore their health, including the prescription, administration and supply of medicinal products and medical devices;\r\n<\/span>\r\n<span>Public providers of higher education.<\/span>\r\n<\/div>\r\n<strong>A dispute cannot be considered by the consumption mediator when:<\/strong>\r\n<div class=\"bpcmsp\">\r\n<span>The consumer is unable to demonstrate that they firstly endeavoured to resolve their dispute directly with the trader through a written complaint as per the procedures stipulated, where applicable, in the contract;<\/span>\r\n<span> The request is manifestly unfounded or wrongful; <\/span> \r\n<span>The dispute was previously considered or is being examined by another mediator or by a court;<\/span>\r\n<span> The consumer has submitted the application to the Mediator more than one year after making their written complaint to the trader; <\/span>\r\n<span> The dispute is not within their field of competence. <\/span>\r\n<\/div>\r\n<p> The consumer is informed by the Mediator of the rejection of their request for mediation within three weeks of receipt of their file.
