A new European advance in mediation for the benefit of consumers<\/span><\/p>\n

The Club de M\u00e9diateurs de Services au Public<\/i> (Club of Public services Mediators) welcomes the adoption by the European Parliament on 12 March 2013, of the Directive on alternative dispute resolution for consumer disputes and the Regulation on the online settlement of disputes, two proposals presented by the European Commission in November 2011.<\/span><\/p>\n

The Directive provides widespread and facilitated access by consumers of goods or services to alternative forms of dispute resolution, particularly mediation. It provides genuine guarantees concerning the conduct of procedures (transparency, efficiency, speed). It also sets strict but proportionate requirements for mediators as regards independence and impartiality as well as competence (ability to mediate, legal knowledge).<\/span><\/p>\n

The Club de M\u00e9diateurs de Services au Public<\/i> (Club of Public services Mediators), for which the fields of several of its members fall within the scope of the Directive, postal, financial, banking and insurance services, as well as transport and energy, welcomes this new framework which is in line with moves to develop mediation of the highest standard.<\/span><\/p>\n

The Club will be very attentive to its transposition into French law, a process in which it is keen to actively participate.<\/span><\/p>\n

The Regulation provides for the establishment of a European platform for on-line settlement through mediation of disputes relating to goods or services acquired through electronic means. The Club will rapidly make a concrete contribution to the implementation of this project at the service of mediation.<\/span><\/p>\n
