The intervention of the Mediator of GDF Suez and the Mediator with BNP Paribas in the days of the francophone Mediation in Bucharest

On September 12th and 13th, Michel Astruc, the Mediator of GDF Suez and Dominique Chevaillier Boisseau, the Mediator with BNP Paribas, participated in the Days of the francophone Mediation in Bucharest, whose objective was to share the practices of mediation in the French-speaking area, on the initiative of the Institute of the Mediation in french-speaking countries (IMEF) and the ACRFPC (Rumanian body for training).

Both Mediators led the round table dedicated to companies involment in the amicable settlement of disputes, in the service of the RSE (corporate social responsibility of companies). Representatives of Apanova (water distribution in Bucharest), of the national Bank of Romania, Orange, the BNP and GDF Suez in Romania were present.

In this opportunity, TV Romania realized an interview of the Mediator with BNP Paribas and with the Mediator of GDF Suez. They spoke about  the main values which characterize the mediation, such as the listening, respect, neutrality, impartiality, the confidentiality and independence. They also stressed the importance of  encouraging the development of the amicable settlement of the disputes

L’intervention du Médiateur de GDF SUEZ et de la Médiatrice auprès de BNP Paribas aux journées de la Médiation francophone à Bucarest

Les 12 et 13 septembre derniers, Michel Astruc, le Médiateur de GDF SUEZ et Dominique Chevaillier Boisseau, la Médiatrice auprès de BNP Paribas, ont participé aux Journées de la Médiation Francophone à Bucarest, dont l’objectif était d’échanger sur les pratiques de médiation dans l’espace francophone, à l’initiative de l’Institut de la Médiation dans l’espace francophone (IMEF) et de l’ACRFPC (organisme roumain de formation).

Les deux Médiateurs ont animé la table ronde consacrée à l’implication des entreprises dans le règlement amiable des litiges, au service de la RSE (responsabilité sociétale des entreprises). Etaient présents des représentants d’Apanova (distribution d’eau à Bucarest), de la Banque nationale de Roumanie, d’Orange, de la BNP et de  GDF SUEZ en Roumanie.

A cette occasion, Romania TV a réalisé une interview de la Médiatrice auprès de BNP Paribas et du Médiateur de GDF SUEZ. Ils se sont  exprimés sur les principales valeurs qui caractérisent la médiation, telles que l’écoute, le respect, la neutralité, l’impartialité, la confidentialité et l’indépendance. Ils ont aussi insisté sur l’importance d’encourager le développement du règlement amiable des litiges.

LES INTERVENTIONS DES MEMBRES DU CLUB DES MEDIATEURS AU COLLOQUE :  » LA MEDIATION, DES TEXTES A LA PRATIQUE »

Le 10 octobre dernier, plusieurs membres du Club des Médiateurs de Services au Public ont participé au colloque « La médiation : des textes à la pratique», organisé par l’Université du Maine, en partenariat avec la Gazette du Palais. Des interventions ont été réalisées, tout d’abord, sur le thème de la médiation civile, judiciaire et familiale, puis, en deuxième partie, sur les médiations spéciales qui étaient représentées par Marielle Cohen-Branche, Bernard Dreyfus et Michel Astruc.

La deuxième partie du colloque a été engagée par Bernard Dreyfus, Délégué Général du Défenseur des Droits qui a dressé un état des lieux de la médiation en droit public. En ce domaine, la médiation est un concept encore peu développé textuellement, seules deux procédures sont prévues dans le Code de justice administrative qui entrent dans les attributions du juge administratif en matière de médiation. Il a cependant tenu à souligner que malgré l’absence de textes, l’esprit même de la médiation est en fort développement dans les services publics. Marielle Cohen Branche est ensuite intervenue au titre de la Médiation boursière et financière. Elle a rappelé que l’Autorité des Marchés Financiers (AMF) rend des avis sur chaque dossier de médiation qu’elle instruit, soit environ 4 000 avis par an. La médiation en ce domaine, effectue un véritable travail de pédagogie et d’explications lorsque l’établissement financier en cause n’a pas apaisé le litige avec le client.

Enfin, Michel Astruc s’est exprimé sur le thème de la médiation auprès des usagers- clients en donnant l’exemple de la Médiation de GDF SUEZ. Il est revenu sur les missions de cette dernière en décrivant ses actions, ses valeurs et ses objectifs.

Ce colloque a permis de confirmer la tendance actuelle qui est au développement des pratiques de la médiation et ce même auprès des tribunaux. En effet, il s’agit d’un appel fort des citoyens relayés par les pouvoirs publics, qui entrevoient la possibilité, voire la nécessité, d’introduire une dimension amiable dans la résolution des litiges.

THE INTERVENTIONS OF THE MEMBERS OF the CLUB OF THE MEDIATORS DURING THE CONFERENCE :  » MEDIATION : TEXTS TO PRACTICE « 

On October 10th, several members of the Club of the Mediators of Servicesto the Public participated in the conference  » Mediation: from the texts to the practice « , organized by the University of Maine, in partnership with the Gazette du Palais. Interventions were carried out, first of all, on the theme of the civil, judicial and family mediation, then, in second part, on the specific mediations which were represented by Marielle Cohen-Branche, Bernard Dreyfus and Michel Astruc.

The second part of the conference was initiated by Bernard Dreyfus, General Delegate for the Defender of the Rights who introduced  the frame of mediation in public law. In this field, mediation is a concept still little developped in legal texts, only two procedures are present in the Code of Administrative Justice which fall outside the remit of the administrative judge for mediation . However, he emphasized that despite the absence of legal texts, the spirit of mediation is growing strongly in the public services. Marielle Cohen Branch then intervened on the topic of stock market and financial mediation . She recalled that the Financial Markets Authority ( AMF ) gives advice on each treated mediation case, that is to say  approximately 4 000 cases per year.  case and this way contribute to educate the opinion about 4,000 per year. Mediation in this area makes a real work of teaching and explanations when the financial institution in question has not calmed the dispute with the customer

Finally, Michel Astruc spoke on the topic of mediation with users-customers by giving the example of Mediation of GDF SUEZ. He went back on  to the missions of GDF SUEZ describing its actions, values ​​and objectives.

This conference  allowed to confirm the current tendency  which is the development of the mediation practices even within the courts. Indeed, it is about a strong call appeal of the citizens relayed by public authorities, which see the possibility, even the necessity, to introduce an amicable dimension into the resolution of the disputes.
